OFFER AGREEMENT
The online store “autoid.kiev.ua”, hereinafter referred to as the “Seller”, offers any individual or legal entity, hereinafter referred to as the “Buyer”, to place an order and purchase goods, images of which are posted on the website https://autoid.kiev.ua.
By placing an order on the Site, the Buyer voluntarily confirms acceptance of the following terms:
1 GENERAL PROVISIONS
1.1. Terms and Definitions
In these rules for the sale of goods in the online store “autoid.kiev.ua”, the terms are used as follows:
- Rules – Rules for the sale of goods in the online store “autoid.kiev.ua”
- Buyer – an individual over 18 years old with full legal capacity, who places orders and purchases, orders, uses, or intends to purchase goods presented on https://autoid.kiev.ua for personal use, not directly related to business activities.
- Seller – LLC "GERA", EDRPOU code, registered address: 02125, Kyiv, Starosilska St., 1, office 22
- Site – Internet resource with domain address https://autoid.kiev.ua
- Email: info@gera.com.ua
- Online store “autoid.kiev.ua” – a tool for presenting and/or selling goods, works, or services through electronic transactions on the Site.
- Website address: https://autoid.kiev.ua
- Personal Account – personalized site interface for making purchases from the online store catalog.
- Goods – a tangible object offered for sale on the Site.
- Product card – a set of information about the product: name, image, description, price, characteristics, color, size, package, availability, etc.
- Order – properly completed request from Buyer for purchase and delivery of selected goods to the specified address.
- Order cost – total payment by Buyer including discounts, bonuses, and delivery. Includes taxes as per legislation.
- Product price – monetary value of the product in UAH without delivery cost, indicated in the delivery note.
- Agreement – public electronic sales agreement concluded remotely via the Internet between Seller and Buyer.
- Courier company – company providing delivery services, chosen by Buyer on the Site.
- Personal data – Buyer’s information (full name, date of birth, address, phone, e-mail, tax ID, bank account, etc.).
1.2. This agreement is a public offer and does not require signing (Articles 633, 641, Chapter 63 of Civil Code of Ukraine). It has the same legal force as a signed paper contract.
1.3. Acceptance of the agreement (offer acceptance) occurs by 100% payment of the order. The one accepting the offer becomes the Buyer.
1.4. The Seller sells goods retail through http://autoid.kiev.ua
1.5. The product sample is recognized as the design (image corresponding to the article).
1.6. The Seller reserves the right to change the agreement without notifying the Buyer.
2. RIGHTS AND OBLIGATIONS OF THE BUYER
2.1. Buyer undergoes automatic registration on the Site to place an order.
2.2. Buyer orders goods from the catalog and sends the order to the Seller.
2.3. Buyer may clarify product specifications with the Seller before ordering.
2.4. Buyer must correctly provide full name, phone, delivery address, and agree on delivery date/time.
2.5. Buyer must meet the courier at the specified time and address.
2.6. Buyer can refuse delivered goods but pays all transportation costs.
2.7. Payment is made using a method chosen on the Site.
3. RIGHTS AND OBLIGATIONS OF THE SELLER
3.1. Seller confirms acceptance of the order and agrees on characteristics and price.
3.2. Seller delivers goods according to quantity, price, and terms agreed with Buyer.
3.3. Seller guarantees product matches catalog sample; minor differences may occur.
3.4. Seller is not responsible for incorrect data provided by Buyer.
4. DELIVERY
4.1. Delivery throughout Ukraine.
4.2. Seller will try to meet delivery terms, but delays may occur due to unforeseen circumstances.
4.3. Delivery cost is on the website.
4.4. Buyer must check goods upon receipt, report problems, and create an act. Otherwise, Seller is not responsible.
5. PRICE OF GOODS
5.1. Exact price indicated in the catalog.
5.2. Seller may unilaterally change prices.
6. RETURNS AND WARRANTY SERVICE
6.1. Return possible if goods are of improper quality.
6.2. Exchange of proper goods only if appearance and documents are preserved.
6.3. Certain goods are non-returnable (Cabinet of Ministers Resolution No.172, 19.03.94).
6.4. Buyer reports defects within 2 days; product sent for examination; if confirmed – full refund.
7. OTHER TERMS
7.1. Buyer allows processing of personal data for fulfillment and settlements.
7.2. Buyer information is not disclosed to third parties without permission or law.
7.3. Ukrainian law applies.
7.4. Disputes resolved by negotiation; if impossible – in court under Ukrainian law.
8. TERM OF AGREEMENT
8.1. Agreement is effective from the date of payment and remains in force until all terms are fulfilled.
